Boy-Group Tohoshinki to Appear First in THIS Magazine!

Popular Boy-Band Tohoshinki will be appearing the the women’s fashion magazine “JJ” Vol. 3 2010, which will be released on January 22. Within the 35 years of the magazine’s history, it is the first time for a Boy-Group to appear on the cover!

The 5 young men will be featured on 8 pages, whereas individual shots are a must, they also talked about their work and their private lives openly in a 100Q&A session. Moreover there are signed presents up for the fans in a lottery as well.

The photo shooting had been conducted at the end of December last year within a studio in the city, while they had been busy with the preparation for their appearance at the NHK Kouhaku Uta Gassen New Years event and their own recording process. However, despite their tight schedule and the overlapping of plans, they showed wide smiles in the shooting and at the actual place.

Tohoshinki Putting a Spell on Their Fans!

Tohoshinki have just released their 29th Single and banned L’Arc~en~Ciel with “BLESS” to the second position in chart ranking as the CD sold about 170.000 copies of “BREAK OUT.”
Moreover did they make a charming appearance on the cover of the Women’s fashion magazine “JJ“, which was rapidly sold-out in many places. Even a reprint of this issue is now planned!

The opening pages present their illustrations in a special feature for Valentine’s Day. Thereafter follows an 8 page 100 Q&A about their work and private lives.
For every fan there is eventually the chance to win signed pictures of the band…
This issue is certainly something one needs to get a hand on as a fan!!

Tohoshinki releases first best album in February

Tohoshinki releases their first best album on February 17th next year. Album will be in 3 versions: 2 CDs & DVD, 1CD & DVD and just CD.

This best album includes 16 songs from “Purple Line” which they became 1st in Oricon weekly chart for the first time to “Doushite Kimi wo Suki ni Natte Shimattandaro” which was chosen as best song prize at The 50th Japan Record Awards.

With the 2 CD version, additional CD with 8songs contains “Amaku Hateshinaku” which was delivered as digital single in September and was played in the commercial message of candy tablet called “Pinky” which Tohoshinki appeared. And The DVD includes 70 minutes of live in 2006-2009. With the booklet with treasured photos.

On Tuesday, most of the winners of the 51st Japan Record Awards were announced. On December 30, when the awards show is broadcast live, one of the 11 Best Song winners will be given the grand prize (the Japan Record Award) and one of the four New Artist Award winners will be named Best New Artist.

091219 TVXQ Earns 90.3 billion Won In Album/DVD Sales In Japan This Year

Popular group TVXQ place third in highest earning Japanese artistes in album sales in 2009.

According to Oricon’s ‘2009 Oricon Yearly Ranking’ that was released on the 18th that accumulates all singles, albums and DVDs, TVXQ placed third after Arashi and EXILE. 4th and 5th place went to B’z and the Beatles respectively.

Arashi, who placed first, earned a total of 14.6 billion Yen in single, album and DVD sales, and EXILE and TVXQ earned 12.93 billion Yen and 6.89 billion Yen (around 90.3 billion Won or $76 million) respectively.

Oricon introduced TVXQ as “The group that made the biggest leap in 2009 and is continually growing at the fastest rate,” and said, “They were perfectly balanced in all areas and this was the year fans passionately supported them.”

TVXQ not allowed to continue group activities?

SM Entertainment will hold a press conference today regarding the conflict with TVXQ/DBSK/Tohoshinki.

Lawyers of SM Entertainment said:

“The court’s ruling for TVXQ is not fair. They didn’t consider the main reasons of the case. Their long contract is so that we can let them grow and have a long term deal with them. We want to look at their career in the long run and the court’s decision is not letting us do that. This is going to affect TVXQ’s international promotions. It’ll also create confusion for stars that want to have long term contracts and move on to bigger things later in their careers and for the companies that want to nurture talented people for a longer time. Not only that, it’ll have some unwanted consequences on exports of Korean music as well as other issues.”

They continued to say:

“Each year, we adjusted the contracts in favor of the members. Before this problem, the three members never complained about anything. Now that they have succeeded this much, they are complaining. They have just started to reach the top and now want to separate. Before a final decision is made, the three can do their personal and individual work. However, this does not grant the three members any rights as part of TVXQ.”

Because of all this, TVXQ has not been able to work and SM Entertainment will seek to receive compensation for damages during the time that TVXQ has been inactive.

Changmin and Yunho support SM Entertainment

Yunho and Changmin of DBSK/TVXQ have stated that they are on SM Entertainment’s side on the legal dispute between the company and other three members.

They said that they trust SM Entertainment and will be with them in the future. The two also gave a deadline to the other members (Junsu, Yoochun, Jaejoong), saying that DBSK will come back to promote in Korea next spring, so the other three members must make a decision before the 12th of this month.

The two members’ thoughts were delivered through a document compiled by Yunho and Changmin themselves, which stated:

We five members of DBSK signed the same contract with the same clauses and for the past five years, and have worked together under same conditions with utmost trust in the company, each other and our dreams. We intend to share our dream and future with the company and keep the promises we made in the contract. DBSK was made by SME and we intend to work as DBSK with SME.

No other company can create DBSK, as only SME can provide the best production and management team available. The three members must know better than anyone else that SME is the one who knows DBSK the best and made DBSK the best. We intend to keep trust and promise and thus intend on staying with SME. DBSK’s grand future will be with SME. We believe that our Korean promotion, planned for next spring, should be prepared at least six months in advance before our future as one DBSK becomes unclear. If the other three members truly want to stay as one DBSK, they must make a decision before it is too late.

They also commented on the beauty product controversy which sparked this legal dispute between the DBSK trio and SM Entertainment:

The beauty product business changed everything. We are not familiar with the matters but we believe that a legitimate company that seeks to do business with DBSK must consult with SME first. It is common sense. We did not get involved as getting involved with a company that sought to do business without SME would have meant that trouble was ahead.

We did not want the reputation and pride of DBSK, earned by our hard work, to get ruined by a beauty product company that did not work in a legally respectable manner. We are not aware of the contract between that company and the three members, nor do we know what those members were told or how much they have earned through their deal. What we do know is that the fact that DBSK, forged together for 5 years by all of our dreams, has fallen into its current state because of an unethical company that is simply unacceptable.

With DBSK crumbling away like this, the current situation is unbelievable. It is sad to see that this was all caused by some beauty product company, and we hope that the three members would come back to the days when we were all working hard for our dreams.

Yunho and Changmin’s fathers express strong disapproval of other members

Many readers and TVXQ/DBSK fans were shocked when members Yunho and Changmin revealed their support for SM Entertainment just an hour ago. But it looks like things aren’t ending there – two other very important men involved with this controversy have decided to express their thoughts.

The fathers of Yunho and Changmin, the two TVXQ members who were not involved with the controversial lawsuit earlier this year, spoke up in support of their sons and SME while condemning other three members and their parents. They claim that the dispute has more to do with the trouble that has arisen from the beauty product business rather than mere contractual matters.

Mr. Chung, the father of Yunho, stated:

The two members who did not involve themselves in this legal dispute are the real victims here. They suffered from financial loss, psychological suffering and most importantly they lost their reputation. Who is to compensate them for their losses? I intend to ask the other three members this: Whatever the reason, why do you intend to cause such great controversy and drive DBSK, an international brand name, into a break-up? Do you care at all about the other two members and their suffering?

The beauty product business wasn’t something that was supervised by SME. On top of that, the beauty product company itself wasn’t very trustworthy. When it was started, I felt that DBSK’s reputation could potentially suffer from involvement with that company and advised my son of the issue. He shared my concerns as well, and that is why he did not involve himself in the business. SME later asked the three members to withdraw from the business but their parents resisted unreasonably. Mr. Shim (Changmin’s father) and I tried to convince them as well but they simply refused to change their minds. I later learned that the three members took up legal actions against SME without consulting me nor Mr. Shim. DBSK is not owned by those three members only. They ignored not only the controversy that would rise but also the rights of other two members.

Mr. Shim, father of Changmin, stated:

Simply put, the other three members took legal actions against SM because of the beauty product business matter and other reasons which involve their financial gains. What they claim as their reasons, reasons such as unfair contract and unclear profit division are merely excuses to hide the true reason behind their actions. After the three members started the beauty product business, one of the parents called me and told me shenanigans like “This business can be worth millions or even billions in the future. When we tell the media that DBSK has started a business, share price of our company will hit the roof – we will tell you in advance so you can profit from the information.”

Three members claim that the contract is unfair and calculations are unclear, but my son and I have read over the contract with SM clearly and agreed to all clauses, from the very first contract through all five revisions that have been made. For every income my son has received I reviewed all of the the numbers. I feel sorry for the three members and their parents as they must know of the truth but they continue to make false claims.”

SM asks TVXQ members for decision by next week

Major talenthouse SM Entertainment has given three members of TVXQ a 10-day deadline to decide on whether they will be part of the team to resume their activities in Korea next year.

The fate of one of the most successful bands in Korea has been up in the air since Hero Jaejoong, Micky Yoochun and Xiah Junsu asked a court in late July to nullify their exclusive contract with their agency SM Entertainment.

“Our company is set to make preparation’s for TVXQ’s comeback to the domestic music scene next spring. We request for a response on this by the three members by November 12,” SM CEO Kim Young-min stated during a press conference on Monday.

Kim explained that the three members will be able to carry out their individual activities in accordance with a court ruling last week but must go through the agency to resume their activities as TVXQ. The Seoul Central District court granted the three members partial victory of their request, saying that the agency cannot not interfere in their individual activities.

U-Know Yunho and Max Changmin, members of the boy band who had not engaged in legal action against SM, also asked for a decision by the remaining members of their group for a decision saying that they are with the agency on the issue.

“We think we should prepare at least six months in advance to resume our activities in Korea next spring. If you really want to continue your activities as members of TVXQ, please make a decision before it is too late,” the two said in a written statement distributed at the press conference.

Both SM and the two also pinpointed to the cosmetics business as being the cause of the issue. “This is not an issue of unfair terms of contract, human rights or a slave contract…… Many things changed after the three started their cosmetics business which led to clashes and conflict within the group and our company,” Kim explained.

U-Know and Max ended their statement by saying: “It is distressing to see how this could happen over a cosmetics business and we hope things can go back to where they were before all of this.”

TVXQ, who debuted in 2004 with album “Hug”, is one of Korea’s most successful K-pop groups. They are stars throughout Asia, reportedly having the largest fanbase in the world, and have enjoyed great success in the Japanese music industry in particular.

Before the ruling, all TVXQ members had signed as a confirmation that they will be participating in the Shenzhen Concert. This event will definitely not be affected by the conclusion of the lawsuit. Kim Jaejoong, Jung Yunho, Park Yoochun, Kim Junsu and Shim Changmin had all participated.

Since the Shenzhen stop was decided by both sides before the verdict had been signed, the performance will not be affected, regardless of the outcome of the court’s decision. TVXQ will bring a full line-up scheduled appearance in Shenzhen to the Chinese fans, bringing the most exciting concert encore.

Regarding the rumours indicating that there would still be Chengdu, Guangzhou and Nanjing stops after Shenzhen, the company stated that “TVXQ’s concert in Shenzhen to be held on the 21st is definitely the 3rd Asia Tour final station. They will perform a complete line-up, and paint a successful closing for the 3rd Asia Tour.”

Court rules partial provisional disposition of exclusive belonging terms for TVXQ’s contract with SM Ent

The court has gave out the final ruling on the lawsuit between the 3 members of Dong Bang Shin Ki and SM Entertainment.

Seoul Central Court revealed on 27th October a citation of their ruling for the lawsuit between the SM Entertainment and TVXQ Hero JaeJoong, Xiah JunSu and Micky YooChun.

It was revealed, “We see that part of the terms in their contract has much destroyed the good morals of the whole contract. SM Entertainment should not interfere with its singers’ independent unique activities and also contract to perform and other entertainment activities.”

Previously in July, the 3 members of Dong Bang Shin Ki has revealed their 13-year long contract under SM Entertainment, which meant that they will possibly be working under SM Entertainment for life, and has applied for the effect of provisional disposition of the terms in their contract. And the 2 parties have engaged in a lawsuit as SM Entertainment insist that the terms under their contract are reasonable.

The court also revealed, “Through the individual agreement, there is high possibility for group activities to continue, but for the provisional disposition of the existing activities and the profit allocation, it is invalid and difficult. We will have to dismiss the application for the full provisional disposition of the effects of the exclusive belonging terms in the contract.”

Updates: The 3 members have announced that they will agree to the court rulings on this lawsuit

Court Rules for 3 Renegade TVXQ Members

The Seoul Central District Court gave a partial victory to three members of the five-man boy band TVXQ in legal action taken to free themselves from their contract with SM Entertainment.

The three are now free to appear in dramas, commercials and movies, while awaiting a final verdict on the contract.

After the court’s decision, legal representatives for the three said that they will continue their action until the contract is declared null and void.

The three ― Hero, Micky and Xiah ― compared their 13-year exclusive contract with SM with a slave deal and submitted an application for provisional disposition regarding their contract with SM. With the three bolting, the once-popular group is as good as disbanded.

They claimed that they were not treated fairly by the agency in terms of profit distribution.

The court stated that “SM Entertainment cannot sign a contract opposes the petitioners’ intention or obstructs their individual activities.”

“Because the group has the possibility to stay together and continue their activities through mutual agreement and it is hard to conclude that the profit issues are invalid, the court will not completely dissolve the contract at this time,” the court said.

I’ll just look on the bright side:

  • Before, it is impossible that I can manage Jaejoong’s career but to look at how things would turn out, I think it will be probable. It will be nice if there is agency ran by meticulous Cassies. Jae, what show would you like to appear in as a comeback on Korean TV? (Jae: Head to the Ground.) That would help the ratings.
  • Jaejoong and me will have a longer vacation and maybe decide to have kids in the future. Oh we haven’t really talked about it yet but I’m just assuming he still has savings out of the peanuts he has been receiving and of all that shopping. 😉
  • DBSK are still sleeping together. Sometimes I catch my husband waking up in the middle of the night, walking out from our bedroom and going back at before dawn when he thinks I’m asleep. Whose room is he visiting? Yoochun’s. (Y_Y) And sometimes—Yunho’s. (T_T)

Members of K-pop idol group TVXQ and its agency have failed to reach a court-mediated settlement of a legal battle over what the group called “unfair”‘ terms of their contract.

A Seoul district court said Wednesday it called in three members of the boy band at the end of September to mediate a settlement with their agency, SM Entertainment, but the mediation collapsed.

Court officials said the members refused to accept the mediation, leaving the court to make a ruling on the injunction in the near future.

The controversy over the five-member group’s working contract touched off in late July after three of its members ― Micky, Xiah and Hero ― filed an injunction with the Seoul Administrative Court to nullify the validity of their contract with the agency. The other two members, Max and U-Know, did not take part in the action.

According to the legal document filed, the agency prohibited their freedom as artists by claiming that the activities of the group and its members belonged to the agency, requiring them to follow the its demands to appear at certain performances and broadcasts, and to stay under its wing for 13 years.

TVXQ debuted in 2004 with the album “Hug”‘ and shot to stardom in Korea, Japan and other parts of Asia. Their subsequent albums were well received and their fourth album, “Mirotic,” released last year, sold 500,000 copies here despite sluggishness in the local record market.

Dong Bang Shin Ki court mediation failed, court decision to be revealed soon

The three members of group Dong Bang Shin Ki who have unfair contract dispute with their agency SM Entertainment presented at the court secretly on last October 13th, however had failed to reach agreement with SM.

Previously on October 12th, the two side had submitted a final official stand documents that have been required since early this month for review to make final decision.

At the end of July this year, 3 Dong Bang Shin Ki members (Jaejoong, Yoochun, and Junsu) filed their disposition application to Seoul Central District Court to terminate the exclusive contract effect against SM Entertainment.

Reportedly on July 30th at 4 pm, wearing sunglasses, the members entered hurriedly to the side entrance of the court building. They secretly received report about the trial request date and other information regarding the case was not disclosed. There was no appearance of the fans, and even most of court staffs couldn’t recognize the three members who disguised themselves just like ordinary civilians and they could move without any fuss.

On August 22nd the legal representative of the 3 members forwarded members’ thought to the court, “We found it very difficult to improve and reach our goals in this industry if we live under SM’s management with all its terms and conditions.”

It’s also reported that, “The arguments happened with SM Lee Soo Man regarding this dispute already reached our highest limit of emotion.” Meanwhile the other two members who don’t participate in the legal case and still have listed activities with SM said, “It’s not possible to breakdown a group of 5 people who actually still want to work together.” showing their intention to keep shinning together as a group.

After the failure of yesterday’s mediation between two sides, court won’t summon the 3 members any further and will make its final decision soon.

In the past three months, DBSK members and SM Ent attended at the Seoul Central District Court to coordinate the process of the case. The court agreed that both sides should come up with an amicable decision but because of the differences between each other, the agreement did not end the conflict.

For TVXQ “They have the deep feeling that their goal which is changing their work conditions seems to be difficult to reach”.

The court is planning to make a difficult decision for both sides later in the month.
